General Terms and Conditions of Sale

Acceptance of Terms

The customer acknowledges having read and accepted, without reservation, the special terms of sale in force at the time of ordering.

These general terms govern the contractual relationship between BY CLASSY LDA and its customers. Both parties accept them without reservation. These terms shall prevail over any other conditions appearing in any other document, unless expressly agreed otherwise in writing.

Orders

Automatic recording systems are considered valid proof of the nature, content, and date of the order.

LUZIRLUMINAIRES.COM confirm order acceptance via email to the address provided by the customer. The sale is only considered final upon confirmation. BY CLASSY LDA reserves the right to cancel any order from a customer involved in a prior payment dispute.

The buyer is responsible for the accuracy of the information provided. In case of an address error, the seller cannot be held liable for failed delivery.

Prices

Prices are expressed in euros. Product sheet prices do not include shipping.

The price stated in the order confirmation is final, including VAT for France and EU countries. It includes product cost, handling, packaging, and — where applicable — shipping and installation.

Prices correspond to items in stock and displayed at Ed. Alva Park, Estrada N 242, 2445-012 Pataias - PORTUGAL.

Payment

The amount invoiced to the customer is that indicated in the confirmation email from LUZIRLUMINAIRES.COM.

Payment is due on the order date.

For your security, we use one of the most reliable online payment systems available. Your card payment is processed directly through a secure server, and your card number or related confidential data are never disclosed to us.

All transactions are encrypted via a PCI-DSS certified platform, complying with the highest payment security standards.

BY CLASSY LDA reserves the right to refuse any order from a customer with an outstanding dispute.

Disputes

This contract is governed by portuguese law. BY CLASSY LDA shall not be held responsible for any damage of any kind — material, immaterial, or bodily — resulting from malfunction or misuse of the products sold.

In any event, BY CLASSY LDA’s liability is limited to the order value.

In the event of a dispute, the buyer should first seek an amicable resolution, possibly with the help of a professional association, consumer group, or other mediator.

Pursuing an amicable settlement does not suspend legal warranty deadlines. All complaints will be handled attentively and in good faith. In case of dispute, the customer must first contact the company to obtain an amicable solution.

Upon delivery, the recipient must carefully inspect the parcel and its contents, note detailed reservations in case of damage, and keep a clear photo showing the Colissimo number. Without this, no refund or compensation can be processed.

Warranty

BY CLASSY LDA’s liability is strictly limited to the value of the product in question at the date of sale, without recourse against the brand or manufacturer.

The customer benefits from the legal warranty against hidden defects (Articles 1625 et seq. of the Civil Code). If the buyer proves the defect, the seller must legally remedy all its consequences (Articles 1641 et seq.). Any court action must be initiated within a “reasonable time” after discovery of the defect (Article 1648).
